But What Exactly is the New Expungement Law in Arizona? 

For the first time ever, Arizona now has an expungement law that will seal your old criminal record.

This means that if you file a Motion to Seal your record, and the Court grants it, you can then state that you have never been convicted or arrested for a crime in Arizona.

 

How Long Does Expungement Take?

And the process is faster than you might think! The actual process of expungement in Arizona takes only takes 60 to 90 days. Under the statute, the Court must wait 30 days before ruling on an expungement motion. However, Arizona judges give the Department of Corrections (Prison System) 60 days to respond to Motions to Seal.

What Crimes Cannot be Expunged in Arizona?

Of course, there are some convictions that cannot be expunged under the new law, such as dangerous offenses against children, weapons offenses, and murder cases.

But if you’re not sure whether your old criminal case is eligible for expungement, don’t worry! Just give my law firm a call, and we’ll help you figure it out.

Also, it’s important to note that there are exceptions to saying “NO” on applications. You’ll still have to disclose when filling out fingerprint clearance cards, applying for a position with the courts, police, or probation department, or applying for foster care with the state, to name a few.

But in general, old cases that are not directly relevant to the current application can be left in the past.
