A disturbing trend in accident cases is that insurance companies are going on peoples’ public Facebook accounts to see if they are really injured. Yes, it sounds unbelievable, but they are. In the past, in a big case, insurance companies may have sent an investigator out to take pictures of you doing activities. Now, they just log on to Facebook.
Now, in big or small case, they just log on to Facebook. As of 2017, I haven’t heard of the insurance companies going on peoples SnapChat, Instagram, Twitter, or Periscope accounts, but I’m sure they do. Despite all the other social media sites, Facebook is still the most popular.
Your bike racing or hiking pictures will ruin your injury claim faster than anything else. In a typical car accident case, there are two main issues – who’s at fault, and how bad are you hurt. Most attorneys, including myself, will not accept a case unless it is clear that my client is not at fault. So that leaves most fights about how bad you are hurt.
I argue you’re hurt, the insurance company says you’re not. As you can imagine, it doesn’t help your case when insurance companies find pictures of you alligator wrestling, mountain climbing, bull riding, etc, just days after the accident.
