You may be surprised to hear that in a court of law, it does not matter who, if anyone, gets a ticket at an accident scene.
A police ticket is not allowed to come into evidence in an auto accident trial or arbitration. In fact, in addition to the ticket, the police officer’s full written “Accident Report” is also not allowed into trial.
The basic reason for excluding the ticket or report is that a trial is about the evidence presented in court, not a report that was written by one cop who most likely didn’t even see the accident happen – just arrived afterward.
With that said, whoever got the ticket at the scene does influence an insurance company’s opinion as to who was at fault. Since most auto accident cases settle before court, who got cited at the scene will affect how soon the case settles.
