At least 7-10 times a year I get a call from someone wanting to know if they can get an old criminal conviction erased.

The bad news is that there is no way to get it erased similar to having a juvenile record sealed at 18.

But, in Arizona, you can have an old conviction “set aside.” If a judge grants your motion to set aside, your record will show your judgment was vacated, and the charges against you have been dismissed, instead of a criminal conviction.

If you have been convicted of a felony, you need to file a Motion To Set Aside, and a Motion To Restore Civil Rights, and a Motion to Restore Your Gun Rights.

The good news is that all these motions are relatively easy to get granted. If you were convicted of two or more felonies, the motion to restore your civil rights will restore your rights to hold public office, serve on a jury, and vote. You must wait two years after conviction to get your right to carry a gun back.
